The Dark Side of Stolen Photos Part 1

14 posts in this topic

As most of you know, wearing my hat as a mild mannered reporter for decades . I've covered the adult video scene and the stripper industry, but never once the escorts ....until the last few months.

My long absences from TOB have been spent as much in court as at work.  Following TOB rules I won't out the names of those involved, but will tell you the facts.

A mainstream model I've know for years was attacked by a man in a bar , thankfully all caught on video. This lady has never been in the adult industry, she has never posed nude for photos, but has done swimwear ads. Unbeknown to her , an escort stole her photos for an escort ad . Those of us that peruse the 411 forum know that this isn't exactly a first.

The man recognized her from the escort ad,approached her..tried to make an escort date and flew into a rage when she stated she had no idea what he was talking about. The police were called ,the man actually told them why he struck her.

I went to court to support her as I would any friend and am actually quite close to the photographer that she had posed for the most . That photographer brought her model releases and other evidence to prove that the photos were shot for mainstream magazines and not for adult publications. Her attacker got major jail time and a hefty fine .

Not long afterwards , the ad with the stolen photos was found. The girl didn't do her screening and was busted by vice. This escort thought that she was just going to get a slap on the wrist . Instead, she was not only charged with prostitution. She was charged with reckless endangerment of another persons life for stealing their photos and using them in her ads. She received a long prison sentence, has to pay the victim restitution  and she was found guilty of copyright infringement and has to pay the photographer too.

The escorts excuse to the judge...she did not want to use photos of herself as she did not want to be recognized in public or by friends and family as an escort.

Part 2 in this series will be more scary.

For part 3 ,  I'm heading back to court to cover the trial of where this girl advertised. Allegedly they don't take government issued IDs from their advertisers ,which would have prevented the use of stolen photos.

Very scary indeed.  I hope the innocent lady did not suffer permanent physical damage. As far as emotional damage, I hope it was minimal and she is able to talk to a professional if she needs to.

Holy shit! This is a very real reality and I hope some of the ladies that need to read this DO!

Thank you, JR.

I’m one of those relics from the days when most escort ads were text only. If photos were included, they tended to be stock material.  Therefore I’ve not been on the “fake photo” band wagon; looks just weren’t that important in my search criteria.  JR has illustrated a serious consequence of photo theft. I will be paying more attention.

JR, I really appreciate this post. Hopefully it will prevent some people, from using other people's pictures.

Scary stuff!

Yikes! Pretty much a worst case scenario with this. And not unusual. Recall a story some years back where a young woman (read: could not vote) was posting pictures of herself on Instagram in bikinis, lingerie. Soon, her pictures were in about every other Backpage ad. And soon started getting creepers coming up to her. Luckily, she was not harmed, but, scared the hell out of her, and pretty much branded a hooker for years.

Unfortunately, the ladies that are stealing pics are not going to stop: craven attitude of better her than me.

I agree wit both of you completely. I understand that providers also have external websites as well. If you had not had a professional site constructed and coded then you photos are at risk of misuse. Exposure to gain broader amount of clientele is great but whenever you market yourself by photo without the photos having embedded encryption you are taking a great risk. As a influencer/model in social media, learning about NDA, Releases and other contracts help enforce laws that govern situations like this. Even a photographer presenting his or her portfolio with possibly your photo is wrong and a direct violation to the model.

The rest is OK but this is a total bullshit charge.  This is one of the major things wrong with the whole criminal industry in the US.  You can do one thing and get charged with 30 different crimes that are all just variations on the same thing.  There is no way in hell any reasonable person would consider using someone else's pictures "reckless endangerment of another persons life."

There is no way in hell any reasonable person would misappropriate someone else's photos/identity for clandestine purposes.  If you accept the story at face value it certainly seems as though the victim was placed in a position of risk. Would you feel the same if the victim was your daughter?

I can steal photos from any website, professional coding or not.  This has been discussed to death on photography forums.  The only way to keep your photos from not being stolen is to not put them online in the first place.

Very true. Also like I had stated the additional sites and the third parties that they are afflicted with is also a contributing factor.

Just one of the reasons why I have hesitated doing any videos. Afraid they will get in the public eye(when I only want it for clients I approve of), and cause attention I don't want. I am glad this girl was caught and charged. You say you didn't want your friends to know, then how the hell do you think that other lady feels to know her pics were being used in a matter that could have cost her her life, and her reputation? It is violating to have someone try to ruin your character, and even worse when they are ruining your reputation by using your name, picture, etc. plus stressful as all get out.

I had a lady try this a few years back, and luckily I knew the  owners of the board at the time, and my photo was pretty well known. She started arguing with me that it wasn't mine and I could shove it, after I asked nicely for her to remove it so I, in turn, notified the owners and she was banned permanently. She wasn't real bright! Don't take pics from an escort that is well known because you will get burned. LOL!

Good for you for standing up for her JR. You are a sweetheart!

xoxo,

Samantha Sheppard

I would be humiliated if I had to use pics that were not me to get a date. You either are the real deal, or not.

As for the trial that Jr was involved with, the sentence was on spot. There are consequences for our actions that often we don't quite realizeuntil it is to late. She learned a hard lesson.
