Question about Colorado's Laws..

A few years ago I worked as a paralegal for a defense attorney my home state of Oregon.I didn't go to school for it and I was hired as a secretary however I really took to it like a fish to water and was promoted to paralegal by the attorney working there within a couple months. (As an aside: is it is NOT true that cops have to tell you they're cops, or that they're affiliated with law enforcement in any way at all. undercover  or otherwise. that is an urban legend that just will not die.. Google it if you doubt what I'm saying and then spread the word because such catastrophic misinformation could get somebody evrn several somebodies in trouble  but I digress)

I promise I'm getting to the point ;  Far too many defendants in criminal cases  talk to the cops without knowing or exercising their right to not speak to them without an attorney present. It does nothing but harm you in the long run because as stated in Miranda is oh so  true everything you say IS used against you later so The attorney I worked for was often left with very material to form his defense. He became and is a pro at looking for loopholes in the law and oftentimes we would sit around for hours looking for loopholes in particular cases.

And to that end   wonder  is there any law against winning sex and/or sex acts in a private ( or any kind) of contest ? 

I do realize that it could be a silly question and it could be the first part of the law on prostitution in Co. so please go easy on me it's my first post and I'm just throwing it out there at least some of you now know that cops Do NOT have to tell you they're cops. 

OH speaking of that after everybody Google's it or whatever they're going to do and realizes it's true maybe if we all tell one person every day for the next five days we could combat this rumor who knows but I can't tell you how many times a week I get asked if I'm a cop

I don't think anyone is going to give you any grief - you asked a really interesting question, but I am not sure what you mean.  Can you elaborate: what do you mean "winning sex."  Do you mean like holding a lottery, or like in strip poker where you run out of clothes but throw an IOUABBBJ into the pot?

Probably in a private game like two people playing Texas Hold'em would it be illegal to bet one's ass to win? More importantly has it ever been written in Colorado law that you can't do that weather privately or a public contest?

Very true. People sometimes people say they have to or its entrapment.  They can and will lie if the are trying to bust someone about somerthing n think about sending in underage to buy alcohol.  They break the law (arresting to purchase under age is a violation ) but it is considered acceptable because they are the ones break the law in order to find a violation. 

Good questionabout winning ...

This is an interesting legal exercise much in the same fashion as the theological exercise "how many angels can fit on the head of a pin?"

However, to many providers and almost all clients, it is a moot point.

In fact, whether client or provider, if you just shut your pie-hole when confronted by LE, and say nothing but "I am claiming my 5th amendment rights and demand my lawyer," you will almost always be able to beat the rap given reasonably competent representation.

However, it is not the verdict that does the harm.  It is the ride downtown that will kill your reputation, kill your career, kill your relationships.  If you get caught in a sting, there is nothing you can do to beat the ride and the mugshot. The cops know this.  THAT is the deterent.

The law is not the issue, here.  It is police procedure.

Not a lawyer or a para, but, first sentence in CO Revised Statutes 18-7-201: "Any person who performs or offers or agrees to perform any act of sexual intercourse, fellatio, cunnilingus, masturbation, or anal intercourse with any person not his spouse in exchange for money or other thing of value commits prostitution."

So, any potential charity fundraising raffles/events are pretty much out.

Saw online fairly recently (ie. last couple of years) that a CO court ruled that gambling via poker is OK as long as it's a social game (ie. friends getting together), and is a game of skill, not chance. So, can put one's literal ass on the line legally in a poker game, just that you're now a hooker and can get pinched for that.

As to ASP urban legends, along the same line, the "oh, I was told to put 'you are not LE' in my ad to protect me" is up there with the "you're not a cop?". And you occasionally get a provider say "but my lawyer told me!". Yeah. Right. Heard it from another provider. Or, if you really DID her it from a lawyer, get a new lawyer.

Also the "body rubs are legal in CO" urban legend. Yes, can rub someone legally in CO, as long as not advertising massage therapy. But once contact is made with fun bits (his and or hers), you are now a prostitute. See CRS 18-7.

Cops can lie ALL THEY WANT TO, they are trained to lie while grinning.

They are trained to Appear more dominant than you.

I totally agree..Please Put the Rumor to Rest.

I never understood why people think a UC has to tell you he/she is a cop, He/she is UNDERCOVER!  LOL

Bottom line is Police are Liars and Can lie all they want to because they can, as long as they tell the truth in court and in reports its considered All for the case.

Depends - does your ass have value?  I would have to say absolutely, and if I were to accept it as security for a bet then absolutely it does.  So, something of a sexual nature with value is exchanged for other things of value (what the other players secure bet with).  Am no attorney, but sounds to me like it runs afoul of both prostitution and gambling laws.  Unless there is zero money exchanged at any point in the process.  Just good clean, legal fun among adults.  Hard to live on though.

And welcome to the board and best wishes!  An interesting first post.

Funny thought, so according to the law above it's ok for your spouse to exchange sexual acts for money. Maybe hitting too close to truth for some people. :)

Also what if you are licensed to perform marriage and you both sign the paperwork before the session but then anointing it afterwards. Does that make it legal?

So, to me, a plain reading of the law kind of puts dating into question.  As soon as you find out some girl will put out for a nice dinner and dancing, that's illegal!

The supreme court has ruled that cops may lie to a suspect during the course of an investigation.

But if you lie to the police, it's a crime. Martha Stewart did not go to jail for insider trading, she went for lying to the feds.

On a side note, the Jeffco DA's office had to shut down an internet sting unit that was used to trap child traffickers.

While the cops can lie, Attorneys and DA employees cannot. They are officers of the Court.

You can also  turn your location services off 😉 Doesn't get rid of the other data, but its one less piece of " evidence" 😊.

The only state where they (LE) can not have sexual contact with you is Michigan, everywhere else it is super legal. I have a friend in Alaska trying to get their laws changed so LE can't have an appointment and then arrest, but other states haven't (no pun intended) jumped on board yet. 

I agree with most of this thread, don't ever talk to the cops guys. xo.

Its a misdemeanor for god sakes!!!!

I know of and personally have seen Crackheads that endanger their kids, don't wash their asses and barely eat,  get off easier than a internet escort. Crazy Crazy Crazy

   Thanks for the chuckle....its right up there with the guy that whips out a video camera and says its legal because he's making a porn !!   Just an endless reminder that the making of pornography is legal via the Hal Freedman Act. One has a lot of hoops to jump through with it,Best to read up on it.

Never been busted myself,but have heard of others that have been by NOT  doing their homework on all facets of the adult entertainment industry. As others have stated..don't say anything without a lawyer.

Although it was not Colorado, I believe I recall a woman some years back who auctioned her virginity....and got rung up for prostitution. Extrapolating, I would speculate that it is NOT illegal for a woman to "raffle off her ass"........so long as she does not charge anything for the tickets.

Amen, Amen! It is the process! I was busted, through my own stupidity, 9 years ago. I beat the rap but the publicity, court appearances and legal fees still haunt me.

I was outed by the pimp AKA 'boyfriend' of a young lady I saw several times. Never saw it coming. He was angry that we had lunch and I did not pay her for her time. I never took his threats serious. He got us both busted. They left town. I dealt with the fallout.

A good point has already been made but I must reiterate. Turn OFF your location setting on your cell phone when visiting a provider. This has got me into trouble. Also, if you are searching a providers address on google maps, go into google maps later and kill this location. Whatever you use, go back and delete the locations. Also delete any and all texting with the provider. The same with emails. The emails often still remain in the trash folder so empty that also.

Skg makes great points, but I would point out that you really can't go into GoogleMaps and delete locations, you need to go into Google itself, go to your Settings, then Privacy and delete the information from there.  For the longest time I didn't think you could delete locations from GoogleMaps, so I carried around about four years of provider locations in my phone.  Now it gets cleared after every appointment, along with all other Google data.
