Another Small Backpage Win

58 posts in this topic

not so much thisI believe that BackPage is doing the right thing for their customers.

as this Escorts give them millions upon millions every year .................................... and what I for one am grateful and think it was an awesome move on their part.

I think you may give BP too much credit for doing the only thing they can to keep their very lucrative business afloat till they perfect third party and other means to purchase.

This kind of behavior is all too typical of governmental officials on a mission. Does not even have to be illegal. For instance, several years ago online cigarette venders located on or owned by native american indian nations were selling cigs with no state or federal taxes. Perfectly legal in every sense of the word. But the attorney general of New York (Mr. Spitzer of caught with high dollar escorts fame) could not stand the thought of New York losing the four to five dollar per pack tax. So he got other states' officials to join him and pressure credit card companies to refuse service to the tribes. They complied. So the tribes found other means. Delayed purchase via personal checks, money orders, etc. Then Mr. Spitzer et. al. leaned upon the feds and lobbied hard enough that the post office refused to pick up and deliver. Not sure where it all ended because thankfully I quit smoking about then. Point is some government officials like this loser sheriff are more than willing to lobby even legal endeavors out of existence and the populace is now docile enough to put up with it. I hope for many reasons, with true freedom at the top of the list, that BP finds successful ways around it and I suspect that they will.

The Presumption of Innocence only applies to Government intervention; I don't know what planet you've been living on, The Court of Public Opinion has been in session for as long as there's been a public.

Yes, lynch mobs have been around since torches were invented.

They enforce conformity with fear, intimidation, and mob violence, which sometimes includes hanging the miscreants.

The dust will never settle because this business is constantly under attack in some way or another and I say support BP during this time. They may ultimately be fighting to continue making piles of money but if so they are still inadvertently helping so many people.

I realize that and I said that in the other post, it may be all about their own interests but what they chose to do was still amazing and helped out thousands of providers all over the place.

My biggest gripe was the douchy Sheriff and how easily the CC companies folded under that pressure. It's a scary thought that you no longer need the law to force the people to do what you want.

Like they did with CL the Media & Morality Police are exploiting this tragedy to further their agenda against BP's adult section.

http://www.foxnews.com/us/2015/07/08/massachusetts-attorney-general-calls-on-backpage-to-shut-down-adult-section/

Instead of blaming the predators who robbed & killed these women, they are blaming the advertising venue which allowed these women to make a living. I wonder how many other robberies occurred in the same area, totally unrelated to BP & escorting? How many of those robberies resulted in murder?

From the article linked by the OP:

Cook County Sheriff's Police say they have made more than 800 arrests since 2009 connected to Backpage adult service ads. Fifty of the arrests were for sex trafficking, involuntary servitude or promoting prostitution.

Fifty arrests? That's about 6% of the arrests related to BP. Also note that the category includes "promoting prostitution" which could be something as simple as placing an ad for someone else, though more likely is a pimp. Also note that there is no mention of under *** trafficking, which I'm sure they would play up if they had any data to support the claim.

Whatever it takes to incite the mob.

Just sayin'

LOL because we weren't aware before? It's not exactly a simple solution nor does it fix any of the real frustration that came with this problem.

Backpage is currently allowing free ads until this has been resolved or they go under. Just sayin'.

I purchased credits sometime ago and it wont let me purchase an ad. It only allows me to post a free ad but the free ads are somewhere lost in cyber space on BP when you post.

Don't know what good it is to have credits just sitting there and i can't use the money.

I doubt this will be an issue. BP is used as the primary place to go for escorts, in countries where it is legal. I was in one city that had over 2000 listings under escorts. BP will ensure they won't lose that income, and provide an easy pay alternative.

Really not sweating the legality of it all either. The US is ever so sloooowly catching up to the times.

[snip}

From a financial side, be careful what you wish for....providers in countries where it legal get 100/hr max if they are lucky. They are also seriously taxed on that income.

I dont know what other countries your referring to But in Australia and new Zealand my favorite place to work btw the going rate is the same as the u.s. & its all decriminalized!

Another battle win in the Cook County vs Backpage threats to credit card processors mess.

http://www.usatoday.com/story/news/2015/11/17/cook-county-sheriff-ordered-to-cease-campaign-against-backpage/75934564/

I posted this in the legalization thread. It's a pretty big win for Back Page but I don't know that it makes it any easier for those of us that have to use it. I doubt Visa and MasterCard will change their minds and AMEX pulled out before Dart sent out the letters.

The whole issue with Sheriff Dart and Back Page is that he is a law enforcer not a law maker. He used his Sheriff letter head and basically sent a cease and desist letter to the CC companies. He abused his power and the CC companies folded and that was what this current ruling was all about. We're on a slippery slope, it's not just the law we have to worry about now. Taking away our ability to pay for our online services is an easy way to stick it to us where it hurts and it's becoming more common.

Seventh Circuit Judge Posner just issued a strong order slamming the Cook County Sheriff for threatening backpage.

https://web.mail.comcast.net/service/home/~/?auth=co&loc=en_US&id=112214&part=2

In his public capacity as a sheriff of a major county (Cook County has a population of more than 5.2 million), Sheriff Dart is not permitted to issue and publicize dire threats against credit card companies that process payments made through Backpage’s website, including threats of prosecution Case: 15-3047 Document: 51 Filed: 11/30/2015 Pages: 20 12 No. 15-3047 tion (albeit not by him, but by other enforcement agencies that he urges to proceed against them), in an effort to throttle Backpage. See Bantam Books, Inc. v. Sullivan, supra, 372 U.S. at 67. For where would such official bullying end, were it permitted to begin? Some public officials doubtless disapprove of bars, or pets and therefore pet supplies, or yard sales, or lawyers, or “plug the band” (a listing of music performances that includes such dubious offerings as “SUPERCELL Rocks Halloween at The Matchbox Bar & Grill”), or men dating men or women dating women—but ads for all these things can be found in non-adult sections of Backpage and it would be a clear abuse of power for public officials to try to eliminate them not by expressing an opinion but by threatening credit card companies or other suppliers of payment services utilized by customers of Backpage, or other third parties, with legal or other coercive governmental action. With very limited exceptions, none applicable to this case, censorship—“an effort by administrative methods to prevent the dissemination of ideas or opinions thought dangerous or offensive,” Blue Canary Corp. v. City of Milwaukee, 251 F.3d 1121, 1123 (7th Cir. 2001), as distinct from punishing such dissemination (if it falls into one of the categories of punishable speech, such as defamation or threats) after it has occurred—is prohibited by the First Amendment as it has been understood by the courts. “Threatening penalties for future speech goes by the name of ‘prior restraint,’ and a prior restraint is the quintessential first-amendment violation.” Fairley v. Andrews, 578 F.3d 518, 525 (7th Cir. 2009).

The consolidation just killed the conversation.  Too big a thread with too big a topic.

There are the legal/free speech issues and the practical issues.

They should be separate.

This wasn't the thread I was referring to. But your thread was the 3rd time that news was posted.

The opinion on the merits just came out yesterday, so it was brand new news on the same case. Not the third time

The title of the topic was now incorrect. Yesterday's decision was not a small win on a temporary interim order; the new decision is a big win with national implications by a highly respected federal appellate judge.

And perhaps the start of a bigger pushback against the trafficking myth.
